New Dawn Financial ("we," "us," or "our") is a credit repair organization as defined by the Credit Repair Organizations Act (CROA), 15 U.S.C. § 1679a(3), and a credit services business under the Virginia Credit Services Businesses Act, Virginia Code § 59.1-335.1(1). We respect your privacy and are committed to protecting the personal information you share with us.
This Privacy Policy explains what information we collect, how we use it, with whom we share it, and the choices you have. It applies to information collected through our website and in connection with the credit repair services we provide under our Credit Repair Services Agreement.
2. Information We Collect
Information you provide to us
- Contact information — your name, email address, and mailing address when you contact us or enroll in our services.
- Identity verification information — information reasonably necessary to verify your identity and access your credit reports, which may include your date of birth and government-issued identification details, collected only after enrollment and with your authorization.
- Credit and financial information — credit reports, account information, and related documents you provide or authorize us to obtain in order to perform dispute services on your behalf.
- Payment information — ACH bank account or credit/debit card details used to bill fees in arrears after each completed 30-day service cycle. Payment data is processed by our payment processor; we do not store full card numbers on our systems.
- Communications — the contents of emails and other correspondence you send us.
Information collected automatically
- Usage data — standard web log information such as browser type, device type, pages visited, and referring pages, used to operate and improve the website.
Our website does not use advertising trackers, and we do not sell visitor data.
3. How We Use Your Information
- To provide credit repair dispute services under your Credit Repair Services Agreement;
- To communicate with you about your account, disputes, and results;
- To bill fees in arrears by ACH or credit/debit card as authorized;
- To comply with legal obligations under CROA, the Fair Credit Reporting Act (FCRA), the Virginia Credit Services Businesses Act, and other applicable law;
- To maintain records as required by law;
- To protect against fraud and unauthorized activity.
4. How We Share Your Information
We do not sell your personal information. We share information only as needed to deliver our services and comply with the law:
- Credit bureaus and furnishers — to submit disputes on your behalf as you authorize.
- Our recommended credit monitoring vendor — if you elect credit monitoring, you will establish a direct relationship with that vendor, whose platform integrates with our system. The vendor's own privacy policy governs its handling of your data.
- Payment processors — to process ACH and card payments.
- Service providers — vendors who support our operations (e.g., secure document storage, email), bound by confidentiality obligations.
- Legal compliance — when required by law, subpoena, or court order, or to protect our legal rights.
5. Data Security
We use commercially reasonable administrative, technical, and physical safeguards to protect your information, including encryption in transit and restricted access to sensitive records. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach affecting your personal information occurs, we will notify you as required by applicable law.
6. Data Retention
We retain client records for as long as needed to provide services and as required by law. CROA and Virginia law require credit services businesses to maintain certain records; we retain contract and dispute records for a minimum of the legally required period, after which they are securely destroyed.
7. Your Rights and Choices
- Access and correction — you may request a copy of the personal information we hold about you and ask us to correct inaccuracies.
- Cancellation — you may cancel services as described in our Cancellation Policy.
- Email communications — transactional emails about your account are necessary to the service; you may opt out of any non-essential communications at any time.
- Direct disputes — you always retain the right to dispute information directly with any credit bureau at no cost, without using our services.
8. Children's Privacy
Our services are intended for adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.
9. Changes to This Policy
We may update this Privacy Policy from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated to active clients by email.
