1. Acceptance of These Terms
These Terms of Service ("Terms") govern your use of the New Dawn Financial website. By accessing or using this website, you agree to these Terms. If you do not agree, please do not use the website.
New Dawn Financial is a credit repair organization as defined by the Credit Repair Organizations Act (CROA), 15 U.S.C. § 1679a(3), and a credit services business under the Virginia Credit Services Businesses Act, Virginia Code § 59.1-335.1(1).
2. The Website vs. Our Services
This website is a marketing and informational resource. Credit repair services are provided only under a separately executed Credit Repair Services Agreement, which includes all consumer disclosures required by CROA (including the Consumer Credit File Rights statement and Notice of Cancellation) and Virginia law. If there is any conflict between these Terms and your signed Credit Repair Services Agreement, the Agreement controls with respect to the services.
3. No Guarantees
New Dawn Financial cannot and does not guarantee the removal of any item from your credit report, the improvement of your credit score by any specific amount, any specific timeline for deletion or correction of any item, or any particular financial outcome. Only information that is inaccurate, incomplete, or unverifiable under the Fair Credit Reporting Act (FCRA) may be lawfully disputed. Accurate, complete, and verifiable negative information cannot be removed by any credit repair organization before the applicable FCRA reporting period expires. Results shown on this website are representative examples, are not typical, and are not guaranteed. Individual results will vary significantly.
4. Fees and Payment
- Dispute service fees are billed in arrears upon completion of each 30-day service cycle. Nothing is due upfront for dispute services, consistent with 15 U.S.C. § 1679b(b).
- Accepted payment methods: ACH bank transfer or credit/debit card.
- Credit monitoring, where elected, is an additional service billed upfront through our recommended vendor, with whom you contract directly.
5. Your Responsibilities
- Provide accurate, truthful information. Federal law prohibits making false or misleading statements to credit bureaus or creditors.
- Use the website only for lawful purposes.
- Do not attempt to interfere with, disable, or circumvent the website's security or functionality.
6. Not Legal or Financial Advice
Nothing on this website constitutes legal, financial, or tax advice, and no attorney-client or fiduciary relationship is created by your use of this website. For advice about your specific situation, consult a licensed attorney or financial professional.
7. Intellectual Property
The content of this website — including text, graphics, logos, and design — is the property of New Dawn Financial and is protected by applicable intellectual property law. You may not reproduce, distribute, or create derivative works from the website content without our prior written consent, except for your personal, non-commercial reference.
8. Third-Party Links and Services
The website may reference third parties, including AnnualCreditReport.com and our recommended credit monitoring vendor. We are not responsible for the content, policies, or practices of third-party sites or services. Your relationship with any third party, including the monitoring vendor, is governed by that party's own terms.
9. Disclaimer of Warranties
The website is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.
10. Limitation of Liability
To the fullest extent permitted by law, New Dawn Financial will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the website. Nothing in these Terms limits or waives any right you have under CROA, the FCRA, the Virginia Credit Services Businesses Act, or other applicable consumer protection law — those rights are non-waivable, and any waiver of them is void.
11. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia and applicable federal law, without regard to conflict-of-law principles. Any dispute relating to the website will be brought in the state or federal courts located in Virginia, except where applicable law provides otherwise.
12. Changes to These Terms
We may revise these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of the website after changes take effect constitutes acceptance of the revised Terms.
